Mediation As A Tool for Divorce in Celebrity Case

Mediation has become a common tool to be used in divorce cases. Judges often times ask both parties to attend several sessions of mediation to settle their case. Why? Well mediation is the use of a neutral third party. The goal of the mediator is to not determine the agreement by the mediator, but empower the parties to come to an agreement. A mediator must have the capacity to shift or transform the ill and negative feelings of the parties to a neutral ground where they will be able to compromise. The main objective in mediation is enable the parties to determine a mutual agreement and not depend on a decision made by a judge.

The mediator will not force the parties to come into an agreement. On the contrary, the mediator will hold the hands of the party so that they can move towards settling their interests. Mediation as become a vital tool and is used in many aspects of conflict.

The Daily Mail posted an article on the Real Housewives of Beverly Hills, Adrienne Maloof to her husband. Mediation was used as a means to settle the divorce, including parent sharing times.

Real Housewives Of Beverly Hills star Adrienne Maloof and her estranged husband Paul Nassif have reportedly come to a custody agreement regarding their three sons.
The couple, who split in July after Nassif filed for separation, are said to have reached an out of court settlement by sitting down with a mediator and lawyers and bashing out a deal.
However, Nassif's wishes for a 50/50 split custody were allegedly not granted, with the lion's share of custody going to Maloof, 51.

'Adrienne and Paul and their respective lawyers met all day on Friday with a mediator, and they were able to come to a custody agreement,' a source told Radaronline.
'Paul had been requesting 50/50 custody arrangement, and he didn't get those terms. The boys will be with Adrienne a majority of the time, with Paul being granted visitation and there are layers of protection in the agreement to ensure the boys are in a safe environment.'
Last month Adrienne was granted a temporary restraining order against  Nassif after accusing him of emotional and physical abuse.
There was also a hearing scheduled to make it long term.
'(It) is still on the docket to be heard, and will likely proceed with Adrienne only seeking for it to cover her and won't include the boys, as it initially had,' the source told Radaronline.
'Both Adrienne and Paul worked diligently to reach the custody agreement that was fair and was truly in the best interests of the children.'
The out of court deal comes as the couple were previously set to go to a Los Angeles court house this coming Tuesday.

Maloof has been the primary caretaker for the children, with Nassif getting minimal visitations with the boys. 
At the end of last month, a Los Angeles court granted the plastic surgeon two supervised visits with the former couple's three sons, nine-year-old Gavin and twins, Christian and Collin, six.
The move came after the Real Housewives star's spouse made a bid to get his visitation rights reinstated after Maloof obtained the temporary restraining order against him, prohibiting him from having any contact with her and their children.
The judge allowed Nassif two monitored visits on both September 29th and October 6th, according to TMZ.
Maloof has previously accused her former husband of abusing their boys.
But her claims that Nassif assaulted her children were dismissed by social workers.

The Department of Children and Family Services looked into the Real Housewives of Beverly Hills personality's allegations against Nassif, and found that they were baseless, according to TMZ.
Last month Maloof made a declaration in court alleging her husband choked one of their sons, and struck another.
But sources told TMZ, the DCFS wrote a report after interviewing the boys and it concluded there was no such abuse.
This is despite the declarations Maloof submitted from several people including Dr. Charles Sophy, who claimed he interviewed the boys and they verified the abuse.
According to the original court filing, two of the boys had been kicking each other, prompting Nassif to reach back and allegedly 'choke one of the boys around the Adam's apple.'

She also alleged that later that day, the boys were taking a bath together and began fighting after one of them 'peed in the tub.'
Maloof alleged Nassif then 'grabbed one of the boys, spanked him hard on the bare bottom and then threw him in the corner.'
It was also reported the estranged couple's chef had filed a declaration alleging he witnessed Nassif 'kicking the family dog when it peed on the floor.'
They also claimed that a DEA agent who is friends with the couple filed yet another declaration claiming he saw 'Nassif putting his hands around the neck of one of the children.'

Nassif, who was not in court for that particular hearing, said he was not told about it and denied all of the allegations.
After the initial allegations were made, his lawyer Lisa Meyer said: 'This smacks of underhandedness. Adrienne wasn't even present when this allegedly occurred.
'It is a sad day when parents have to stoop to the level of making false allegations against another parent.'
It was the latest in what is turning into an increasingly bitter divorce battle between the reality star and her plastic surgeon husband.

During a hearing to discuss the custody of their three sons, Nassif's lawyer alleged in court that Maloof 'pushed him and been verbally abusive' in front of their children, calling him 'stupid, dumb and an idiot.'
According to a filed declaration, the couple's head of security witnessed Maloof 'hit and scratch her husband' in the back of their car last summer, before he called her a 'bitch.'
Both have separately filed for divorce citing irreconcilable differences in their nine-year marriage.
The couple have a pre-nuptial agreement in place and Maloof, whose fortune is said to total $300 million, is said to be confident it will protect her family fortune.
She is the only daughter of billionaire entrepreneur George J Maloof Sr.
Her myriad of business interests include the various holdings of Maloof Companies, of which she is co-owner - notably the Palms Casino Resort in Las Vegas, the basketball team Sacramento Kings, development company Maloof Productions, and record company Maloof Music.
